These Terms and Conditions constitute a legally binding agreement between you and CodeCraft Academy regarding your use of our website, services, and educational programs. By accessing our website or enrolling in our bootcamps, you acknowledge that you have read, understood, and agree to be bound by these terms.
Please read these terms carefully. If you do not agree with any part of these Terms and Conditions, you must not use our services. These terms supplement our Terms of Service and Privacy Policy, which are incorporated by reference.
1. Binding Nature of Agreement
By using our services or enrolling in our programs, you enter into a legally binding contract with CodeCraft Academy. This agreement is effective from the date you first access our website or register for our services, whichever occurs first.
You represent and warrant that you have the legal capacity to enter into this agreement. If you are accessing our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
Your acceptance of these Terms and Conditions creates enforceable obligations between you and CodeCraft Academy. Violation of these terms may result in legal action, termination of services, and other remedies available under law.
2. User Obligations and Conduct
2.1 Legal Responsibilities
As a user of our services, you are legally obligated to:
- 1. Comply with all applicable local, national, and international laws and regulations when using our services.
- 2. Provide truthful, accurate, and complete information when required, including during registration and enrollment processes.
- 3. Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access.
- 4. Respect the intellectual property rights of CodeCraft Academy, instructors, and other users.
- 5. Fulfill all payment obligations in accordance with the terms of your enrollment.
2.2 Prohibited Conduct
You expressly agree not to engage in any of the following prohibited activities:
- 1. Using our services for any unlawful purpose or to facilitate illegal activities.
- 2. Transmitting viruses, malware, or any other harmful code that could damage or disrupt our systems.
- 3. Attempting to reverse engineer, decompile, or extract source code from our software or systems.
- 4. Recording, copying, or distributing course content without explicit written authorization.
- 5. Engaging in harassment, discrimination, or abusive behavior toward instructors, staff, or other students.
- 6. Impersonating another person or entity, or falsely representing your affiliation with any person or organization.
- 7. Collecting or harvesting personal information from other users without consent.
2.3 Indemnification
You agree to indemnify, defend, and hold harmless CodeCraft Academy, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your violation of these Terms and Conditions, your use of our services, your breach of any law or regulation, or your violation of any rights of a third party.
3. Content Guidelines and Restrictions
All course materials, including videos, documents, code examples, and other content, are provided solely for your personal educational use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any course content without our express written permission.
Students are prohibited from recording lectures, sharing login credentials, uploading course materials to file-sharing platforms, or otherwise making course content available to unauthorized parties. Violation of these restrictions may result in immediate termination of your enrollment without refund and potential legal action.
You retain ownership of any code, projects, or work you create during the bootcamp, subject to our right to use anonymized examples for educational or promotional purposes with your consent.
4. Age Restrictions and Requirements
Our services are intended for individuals who are at least 18 years of age. By using our services, you represent and warrant that you meet this age requirement. If you are under 18, you may not access or use our services without the explicit consent and supervision of a parent or legal guardian.
We reserve the right to request proof of age at any time. Failure to provide such proof or discovery that you have misrepresented your age may result in immediate termination of your account and services.
5. Disclaimers and Warranties
5.1 Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CODECRAFT ACADEMY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- • Warranties of merchantability, fitness for a particular purpose, and non-infringement.
- • Warranties regarding the accuracy, reliability, or completeness of course content.
- • Warranties that our services will be uninterrupted, error-free, or secure.
- • Warranties regarding specific career outcomes, job placements, or salary expectations.
5.2 No Guarantee of Results
We do not guarantee that completion of our bootcamp programs will result in employment, specific career advancement, or particular salary levels. Success depends on numerous factors including individual effort, dedication, prior experience, market conditions, and circumstances beyond our control. Any testimonials or success stories represent individual experiences and should not be considered typical results.
5.3 Third-Party Content Disclaimer
Our services may include links to third-party websites, resources, or tools. We do not endorse, warrant, or assume responsibility for any third-party content, products, or services. Your use of third-party resources is at your own risk and subject to the terms and conditions of those third parties.
6. Limitation of Liability
6.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CODECRAFT ACADEMY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- • Loss of profits, revenue, or business opportunities.
- • Loss of data or information.
- • Loss of goodwill or reputation.
- • Costs of procuring substitute services.
- • Any other indirect, incidental, or consequential damages arising from your use of our services.
6.2 Maximum Liability Cap
Our total aggregate liability to you for all claims arising from or related to these Terms and Conditions or your use of our services shall not exceed the total amount you paid to CodeCraft Academy in the twelve months preceding the event giving rise to the claim. This limitation applies regardless of the legal theory under which liability is asserted.
6.3 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or telecommunications failures, or any other force majeure events.
7. Dispute Resolution and Governing Law
7.1 Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of, without giving effect to any principles of conflicts of law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these terms.
7.2 Jurisdiction
Any legal action, suit, or proceeding arising out of or related to these Terms and Conditions or your use of our services must be instituted exclusively in the courts located in Tokyo. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
7.3 Dispute Resolution Procedures
Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us with a detailed description of the issue. We will make good faith efforts to resolve disputes amicably. If the dispute cannot be resolved within sixty days, either party may pursue formal legal action.
7.4 Class Action Waiver
To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.
8. Severability and Waiver
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of CodeCraft Academy to be effective.
9. Modification of Terms
We reserve the right to modify these Terms and Conditions at any time at our sole discretion. When we make material changes, we will update the "Last Updated" date and notify you through email or a prominent notice on our website.
Your continued use of our services after modifications are posted constitutes your acceptance of the revised terms. If you do not agree to the modified terms, you must discontinue use of our services and contact us to terminate your account.
10. Entire Agreement
These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and CodeCraft Academy regarding your use of our services. These terms supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral, relating to the subject matter herein.
